Appeals Board

Meets on the Monday Prior to the 2nd Tuesday Each Month, With Agenda Items

Five members are appointed to the appeals board; one shall be a member of planning board, one shall be a member of council and three members shall be city electors. Citizen members of the appeals board shall serve 5-year terms.  Appeals board shall have the power to hear and determine appeals where it is alleged there is error in any order, requirement, decision or determination made by the enforcing officer in the enforcement of the zoning code.  This board shall also have the power to determine similarity of uses under the zoning code; to determine zoning district boundaries; to permit, in individual cases, exceptions to and variations from the zoning regulations as may be required to afford justice and avoid unreasonable hardship to property owners. The standards to be applied by the board shall be established in the planning and zoning code or by ordinance of council.  Other determinations made by the appeals board shall be implemented only upon an affirmative vote of a majority of those members appointed to the board.
